USERRA is a Federal law intended to ensure that persons who serve or have served in the Armed Forces, Reserve, National Guard, or other uniformed Services: (1) are not disadvantaged in their civilian careers because of their service; (2) are promptly reemployed in their civilian jobs upon their return from duty; and (3) are not discriminated against in employment based on past, present, or future military service. The law is intended to encourage uniformed service so the United States can enjoy the protection of those Services, staffed by qualified people, while maintaining a balance with the needs of private and public employers who also depend on these same individuals.

Richard Palmatier, Jr., Esq. retired after a career as an Army Judge Advocate in 2010, including assignments as the Human Resources Officer and Chief of Staff. He has been accredited for VA practice since 2010, focusing on agency and Board of Veterans Appeals representation, with some appeals to the Court of Appeals for Veterans Claims. In 2017, he joined the State Bar of Arizona, in the General Counsel’s office, focused on conservatorships, employment law, and support to the ethics hotline. He was selected as the State Chair for Arizona’s Employer Support of the Guard & Reserve in 2023, responsible for all levels of ESGR support throughout Arizona. His pro bono dedication is to Arizona’s First Responders, through the Wills for Heroes program.
